Terms of Service

These terms are an agreement between you (the "Customer") and SmallWeb, LLC, an Indiana limited liability company ("SmallWeb," "we," "us"). By purchasing a plan, you agree to these terms.

1. The service

SmallWeb designs, hosts, monitors and maintains a website for your business, as described in the plan you choose (Basic, Premium or Custom). Plan features are described on our pricing page at the time of purchase.

2. Getting your site live

We aim to publish your website on a preview address within 24 hours of receiving your completed onboarding form and any photos, logos or content you want included. Connecting your own domain happens once you're ready and, where needed, once you've given us access to your domain's settings.

For Premium plans, Google Business Profile setup is typically completed during your first month. Timing depends on Google's verification process and on you granting us access; we can't control Google's timelines.

3. Term and renewal

• Minimum term. All plans have a 12-month minimum term starting on your first payment.
• Monthly billing. After the minimum term, monthly plans continue month-to-month until cancelled.
• Annual billing. Annual plans are paid up front at a 20% discount and renew automatically for another year. You can switch to monthly billing at any renewal.
• Renewal reminders. We'll email you before each annual renewal.

4. Payment

Payments are processed by Stripe and charged to the payment method on file. There is no setup fee; your first payment starts your service. If a payment fails, we'll retry and notify you. If payment isn't resolved within 14 days, we may pause your website until your account is current.

5. Cancellation

• After the minimum term, monthly plans can be cancelled with 30 days' notice.
• Annual plans can be cancelled any time before the renewal date; cancellation takes effect at the end of the paid year. Annual payments are non-refundable once a renewal has been charged.
• If you cancel during the 12-month minimum term, the remaining payments for the minimum term become due.

6. Updates

An "update" is a change to existing content: text, photos, hours, services, or the layout of an existing page. New pages, new features and integrations are quoted separately.

• Basic: unlimited updates during your first 30 days; after that, $49 per update.
• Premium: unlimited updates submitted through the support portal. We work on one request at a time and aim to complete most requests within 2 business days. Unlimited updates are subject to reasonable use; a full redesign is not an update.

7. Ownership

• Your domain. Your domain name is registered in your name and is always yours.
• Your content. Text, photos and logos you provide remain yours. You give us permission to use them to build and operate your website.
• Your website. After 24 months of paid service (counted as total paid months), ownership of your website's published files and content transfers to you. If you ask, we'll migrate it to hosting you control at no cost.
• Our tools. Our templates, site-building software, content management system and internal tools remain SmallWeb's property and are not transferred.

If you leave before 24 paid months, your domain remains yours, and your website is taken offline at the end of your service unless we agree on a buyout.

8. Your responsibilities

You're responsible for the accuracy of the information you give us and for having the rights to any content you provide. You agree not to use the service for anything unlawful.

9. Search and AI visibility

We set up every site using search engine and AI search best practices. We do not guarantee any particular ranking, traffic, or placement in search engines or AI tools, which are controlled by third parties.

10. Uptime and support

We monitor your website 24/7 and work to fix problems promptly. Technical support requests are answered during business hours, usually within one business day. We don't guarantee uninterrupted availability, and scheduled maintenance or third-party outages may occasionally affect your site.

11. Limitation of liability

To the maximum extent allowed by law, SmallWeb's total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim. We aren't liable for indirect or consequential damages, such as lost profits.

12. Changes

We may update these terms. We'll notify you by email of material changes at least 30 days before they take effect. Prices are fixed for your current term.

13. Governing law

These terms are governed by the laws of the State of Indiana.
